Introduction

The Florida Department of Transportation (“FDOT”) respects your privacy and is committed to protecting it. This privacy policy (“Policy”) describes the types of information FDOT may collect from you or that you may provide when you visit, access, or use the website www.SunPass.com (“Website”) or the SunPass® Mobile Application (“Application”), and FDOT’s practices for collecting, using, maintaining, and disclosing that information.

This Policy applies to information FDOT collects on the Website and the Application. This Policy does not apply to information collected by any third party, including any content that may link to or be accessible from or on the Website or the Application.

Please read this Policy carefully. By accessing or using the Website or the Application, you agree to this Policy. This Policy may change from time to time. Your continued use of the Website or the Application after such changes are made is deemed to be your acceptance of those changes, so please check the Policy periodically for updates.

Collection of Your Information

FDOT collects information from and about users of the Website and the Application, including information by which you may be personally identified, such as name, address, telephone number, and email address. Information about your internet connection, the hardware/software you use to access the Website or the Application, and usage details may also be collected. This information may be collected either directly from you when you provide it, or automatically through the use of cookies or other automatic data collection technologies as you navigate the Website or the Application.

Information that may be provided by you and collected on or through the Website or the Application may include:

  1. a) Information that you provide by filling in forms on the Website or Application.

FDOT may use cookies to understand site usage and to improve the content and offerings on the Website and/or the Application.

Use of Information

FDOT does not sell information to third parties. Information, including personal information, collected either directly from customers when it is provided, or automatically, is used:

  1. a) To present the Website and the Application, and the contents thereof, to the user.
  2. b) To provide customers with information, products, or requested services.
  3. c) To provide customers with notices about account information.
  4. d) To carry out FDOT’s obligations and enforce rights arising from any contracts entered between FDOT and the customer, including for billing and collection purposes.
  5. e) To notify customers about changes to the Website and/or the Application or any products or services offered or provided.
  6. f) To analyze usage of the Website and/or the Application.
  7. g) To track and improve the design and content of the Website and/or the Application site in order to enable FDOT to personalize the customer experience through the gathering of non-personally identifiable information.
  8. h) To allow customers to participate in interactive features on the Website and/or the Application.
  9. i) To fulfill any other purpose for which it was provided.
  10. j) In any other way FDOT may describe when information is provided by the customer.
  11. k) For any other purpose with customer’s consent.

Disclosure of Information

FDOT may disclose information that it collects, or is provided by the customer, as described in this Policy:

  1. a) To contractors and service providers it uses to support its business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which such information is disclosed to them.
  2. b) To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  3. c)To protect the rights or property of FDOT.
  4. d)To fulfill the purposes for which it is provided.
  5. e) For any other purpose disclosed by it when the customer provides the information.
  6. f) With your consent.

By providing your e-mail address and/or cellular/mobile phone number, you consent to receive information from FDOT, its consultants, agents or other toll facility operators via e-mail or text messages. Additionally, you acknowledge and understand that Interoperable Toll Agencies will observe their respective state laws regarding the disclosure of records and other information related to transactions that use a SunPass® transponder on toll facilities of the Interoperable Toll Agencies, including Prepaid Account information provided by FDOT to the Interoperable Toll Agencies for the purpose of toll payment, collection, or notice.

Public Records

Under Florida law, e-mail addresses are public records. If you do not want your e-mail address disclosed in response to a public records request, do not send an e-mail to us. Instead, contact this office by phone or in writing.

The Department retains and disposes of records made or received in the course of official business in accordance with Chapters 119 and 257, Florida Statutes, and Chapter 1B-24, Florida Administrative Code.

Commitment to Security (Safeguards)

Physical, electronic and procedural safeguards are in place to prevent unauthorized access or disclosure, and to preserve data integrity and ensure the appropriate use of information you may provide through e-mail.
